Terms of Service — Callio

These Terms govern your use of the Callio AI voice receptionist service, website, dashboard, and mobile app (the "Service"), provided by Wojciech Szymański (Alchemicy AI) ("Callio", "we", "us"). By creating an account or using the Service, you ("Customer", "you") agree to these Terms.

1. The Service

Callio answers your business's incoming phone calls with an automated AI assistant, books appointments, records and transcribes calls, and notifies you (the business owner) in the app. The Service is provided on a subscription basis.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be a business (or authorized representative) and at least 18 years old.

3. Your responsibilities & acceptable use (IMPORTANT)

You are responsible for lawful use of the Service in your jurisdiction. In particular, you:

• Have the right to forward your business calls to Callio and to have those calls answered, recorded, and transcribed.
• Acknowledge that Callio's AI discloses at the start of each call that it is an automated assistant and that the call is recorded. You agree not to disable these disclosures, and you remain responsible for any additional consent or disclosure your jurisdiction requires (Callio applies an all-party-consent standard by default).
• Will not use the Service for unlawful, harassing, deceptive, or emergency-services purposes, nor to handle calls for which AI handling is prohibited.
• Are responsible for the accuracy of the agent configuration, business information, hours, and pricing you provide.
• If you operate in a regulated field (e.g., healthcare/HIPAA, legal, financial), you are responsible for ensuring the Service is configured and contracted appropriately (e.g., a Business Associate Agreement) before use; the standard Service is not offered for the processing of protected health information.

4. AI limitations

The AI assistant may make mistakes, mishear, or misbook. The Service is provided as an automation aid, not a guarantee. You should review summaries and appointments. Callio is not liable for missed, miscategorized, or mis-booked calls.

5. Billing

• Subscriptions are billed monthly in advance via Stripe. Prices are as shown at signup. Usage beyond your plan's included minutes is billed at the stated overage rate.
• Cancellation: month-to-month; cancel anytime from the dashboard. Your subscription runs through the end of the current paid period, then ends. No refunds for partial periods unless required by law.
• We may change pricing with 30 days' notice.

6. Referral program ("Refer & Earn")

If you refer another business, you may earn the reward stated in-app only when the referred business becomes a paying customer and remains so through any stated qualification period. Referrals must be made only by sharing your referral link; you may not enter or share third parties' phone numbers for unsolicited contact. Rewards have no cash value unless stated, and we may modify or end the program at any time. Abuse (fake/self-referrals, spam) voids rewards.

7. Notifications

Operational notifications (e.g., call summaries) are delivered as in-app push notifications. You consent to receive them; you can disable push in your device settings (this may reduce the Service's usefulness).

8. Intellectual property

We own the Service and all related IP. You own your business data and the content of your calls. You grant us a license to process that content solely to provide the Service.

9. Third-party services

The Service relies on third parties (Twilio, ElevenLabs, Anthropic, Stripe, Hetzner hosting). We are not responsible for their outages or acts beyond our reasonable control.

10. Disclaimers & limitation of liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST REVENUE FROM MISSED/MIS-HANDLED CALLS.

11. Termination

We may suspend or terminate accounts that violate these Terms or create legal/security risk. You may stop using the Service at any time.

12. Changes

We may update these Terms; material changes will be notified. Continued use after changes means acceptance.

13. Governing law & contact

These Terms are governed by the laws of Poland, without regard to conflict-of-laws rules. Disputes will be resolved by the competent courts of Poland.
